A Reply to Eviction

In December we wrote a letter to a tenant inviting her to leave the park. (Reference the earlier posts about our PITA tenant.) We gave her 60 days notice, but she did not leave until after we officially filed the eviction. She answered the complaint, but then moved her home out of the park before the court date arrived. Our attorney then had it dismissed.

Here is her actual reply. Names have been changed for obvious reasons!

"My name is Jane Doe, I have lived in NorthRidge trailer park for almost 10 yrs now, and as long as I have lived out there I have never had any problems. Mr. Jim Brenn probably took over last summer I believe and when he did he change a lot of things such as, not being able to park on the grass or wash your car in the yards anymore, pets had to be either in the house or tied up, he wanted to know who was in your house and it had to be a certain amount of people living with you in your home. A lot of the residents who live in NorthRidge own their homes and are just paying for the lot rent including myself. He has forced many to leave and people are still trying to move. Mr. Brenn was okay with me until he got into it with my neice she didn't know that she couldn't wash her car on the grass and he approached her the wrong way causing them to argue, and when I came he had an attitude with me. He asked if I've ever been shot before and I asked him was he threatening me. I think he dislikes me because a family member is suing him. After that incident I told him I was going to have my cars removed out the yard during the weekend, but he waited until I left home which was before the weekend and had my cars towed without warning me or anything. A couple weeks later I received an eviction notice from him, he said I had a lot of complaints, but I knew this wasn't true because no one living around me really and everyone gets along out there. In February 2007 I paid my lot fee and later on that night he returned it and said "We don't want you up here." I just took it and put it in the bank when he returned it he had written void all over it, I said nothing to him I just took it and I've been lookin for some land ever since. He has not only given me an eviction notice, but many others. I am a disabled, single mother who receives SSI and I have been saving money to find somewhere else becaue I feel that I have been discriminated and mistreated as an African American and I refuse to pay him the amount of $4,518.75 because for one I have never been late paying him and he did not accept one payment and I know it was not that amount and I would like to see some proof showing that I owe this amount because I have my receipts. In conclusion he has also set up cameras which are located in his truck and also the trailer that is located in front of me and to have someone watching me or peeping in my windows has me terified so therefore I should be the one receiving something even if its just an apology, not him."

We laughed when our lawyer gave us the copy of this reply. The funniest part was about the cameras - she was talking about the GPS in our truck! We have no idea where she came up with the amount of money owed in her reply - records of the past owner as well as our own showed she always paid. (What a shame to have to evict a tenant that you NEVER have to ask for the rent! However, this woman was the main troublemaker in the park.)
