So, After 5 Months An Eviction is Ordered!

Sometimes things take MUCH longer to get done than they ought to, and this eviction is just such a story. We filed papers to evict this woman in September. In November she actually approached two different people who were visiting the park for MOM, asking them to intercede with Jim!

A court date was finally set for December, but we were going on the cruise with MHU, which was at the same time. Beleive me, we were not going to forego a vacation to get this woman out! (The shame of it all is that we are required to have an attorney to represent us, but must also be present in court to testify!)

The eviction hearing was continued until January, when the woman asked for a continuance because she was in the hospital. On to February......

On February 21 an eviction was ordered and we were awarded a judgement of over $1,700 for lot rent and late fees starting in September. She had two weeks to appeal, and appeal she did on the last afternoon. Upon seeing the appeal, our attorney had it dismissed, which was now March 7.

Today is March 29 and said woman is STILL living in our park! After the appeal she went to a low-cost legal clinic and they have gotten the judge to allow her until April 7 to move her trailer out. Yup, you heard right. She is planning to move her trailer out of our park at a cost of somewhere around $1,500.

We have yet to be approached by a mover to make arrangements for the move, and we are so over this woman living on our dime! We asked our lawyer about lot fees, etc. SINCE the judgement was awarded, but he does not know. Funny, isn't it? (NOT) We cannot prevent her from moving her home out, because under Alabama law you cannot keep someone from removing their personal property from your real property.

We don't know if we will ever collect anything from the judgement. Our lawyer is actually quite good at collecting these, but this woman has a federal pension and he was not sure it was one we could attach. At this point, just getting her out of our lives will be a big event.

So, I think this makes 11 homes moved out of our park in about 20 months. We have yet another eviction to file on another of the original residents for rule violations, which we are sure will drag out just as long as this one did. They will probably not have the funds to remove their home, however, but who knows.
